Terms of Service

These Terms of Service ("Terms") govern your access to and use of TPickle ("TPickle", "we", "us"), a web application for running and following racket-sport tournaments, available at tpickle.com and its subdomains (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Who may use the Service

You must be able to form a binding contract to use TPickle. You may use the Service if you are at least 13 years old; if you are under 18, you may only make purchases with the involvement of a parent or legal guardian. You are responsible for anyone you allow to use your account.

Your account

You are responsible for your account, for keeping your login credentials secure, and for all activity under your account. Provide accurate information and keep it current. Tell us promptly if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

The Service, free and premium

TPickle lets organizers create tournaments, score them, and share a public scoreboard, and lets spectators follow along. Some features are free and others are premium.

Premium is available two ways: a one-time upgrade for a single tournament, or a monthly Premium subscription that makes all of your tournaments premium. Prices are shown in the app and may change; the price in effect when you buy applies to that purchase.

Payments, billing, and cancellation

Your content

You and your participants may add content to the Service, such as tournament names, player names, logos, director notes, messages, and photos ("Your Content"). You keep ownership of Your Content.

You grant TPickle a non-exclusive, worldwide, royalty-free license to host, store, display, and share Your Content as needed to operate the Service, including on public scoreboards and shareable recap pages.

You are responsible for Your Content and for having the rights to it. Do not upload content that is unlawful or infringing, or that you do not have permission to share, including other people's names or images without appropriate consent.

Acceptable use

Do not misuse the Service. In particular:

Public tournaments and spectators

Tournaments you publish are viewable by anyone with the link, and premium club pages are publicly listed. Do not publish information you are not comfortable making public. Spectators can post messages, and for premium events photos; as the organizer you are responsible for moderating your event.

Intellectual property

The Service, including its software, design, and the TPickle name and logo, belongs to us and our licensors. These Terms do not give you any right to our branding except as needed to use the Service.

Third-party services

TPickle relies on third parties such as Supabase, Vercel, Stripe, Google, and Resend to operate. Your use of the Service may be subject to their terms, and we are not responsible for third-party services.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that scores, standings, or results will be accurate. You are responsible for verifying tournament results.

Limitation of liability

To the fullest extent permitted by law, TPickle and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive will survive, including intellectual property, disclaimers, and limitation of liability.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in Alameda County, California, unless applicable law requires otherwise.
